Defining the Scope of Aboriginal Rights
Although the equivocal statement in clause one, Section 35 of the Constitution Act is intended to address that there is no overarching definition of indigenous rights due to the societal differences between First Nations groups, the “Sparrow test” was a significant development in the process of defining and expanding Aboriginal rights through the court system. Although the coexistence of contemporary government conservation measures and Aboriginal rights to natural resources often conflict, by using his legal rights to challenge the Canadian government’s policies towards indigenous peoples, Ronald Sparrow reinforced the Canadian government’s duty to maintain a just relationship with Canada’s Aboriginal groups.
