To fully understand the past and consciously reflect on the future, it is fundamental to dissect and analyze major events that have influenced the Aboriginal rights/titles of FNMI peoples. We would be remiss to simply overlook the fact that as a nation we once created assimilationist policies targeted against Aboriginal cultures and beliefs, most notably through residential schools. In addition to this, within 1969, the White Paper was released, created by PM Pierre Trudeau, which proposed the severing of the Indian Act and the discontinuity of the legal relationship between FNMI peoples and Canada. These events have created severe ripple effects, all of which are presently being felt by Indigenous peoples across Canada. Although laws and policies like the clauses within Section 35 have been implemented to ease aboriginal right conflicts, these laws are proving to be constraining and rudimentarily flawed.
